RELEASE OF LIABILITY, WAIVER OF CLAIMS & ASSUMPTION OF RISK AGREEMENT

Please read carefully before signing. In consideration of being permitted to participate in paddle boarding and kayaking activities organized by Nani (the “Organizer”) on this day, I, the undersigned, hereby acknowledge and agree to the following:

1. Assumption of Risk

I understand and acknowledge that paddle boarding and kayaking involve inherent risks, dangers, and hazards, including but not limited to: drowning or near-drowning, hypothermia, physical injury from falls or capsizing, collisions with other watercraft or objects, strong currents or winds, adverse weather conditions, equipment failure, entrapment, and other unforeseen circumstances. I freely and voluntarily accept and assume all such risks, both known and unknown.

2. Release and Waiver of Liability

In consideration of my participation in this paddle board and kayak event, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Nani, its organizers, volunteers, participants, sponsors, and all associated parties (collectively, “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in or traveling to and from this event, regardless of whether caused by the negligence of the Released Parties.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including legal fees, that they may incur due to my participation in this event, whether caused by my negligence or otherwise.

4. Medical Authorization

In the event of an emergency, I authorize the Released Parties to seek and obtain emergency medical treatment on my behalf. I acknowledge that I am responsible for all costs associated with any such treatment.

5. Acknowledgment

I confirm that I am physically fit and capable of participating in this activity. I have read this waiver in its entirety, understand its terms fully, and sign it voluntarily. This agreement is binding upon me, my heirs, executors, administrators, and assigns.
